BRANDT thanks you for your interest in finding out how we process personal data. We want you to know that respect for privacy is of paramount importance to us, so in the following sections we will explain the data we collect from Users, how we use them (“Processing”) and the purpose for doing so (“Purpose”), among others.

We will use your personal data provided that we have the right to do so or we have your consent to do so (“Legal Basis”).

1. Who is responsible for the processing of your personal data?

The data controller is BRANDT EUROPE, S.L. (hereinafter BRANDT), a company legally established in Spain, with registered address for these purposes at Carretera Carmona-Guadajoz, kilómetro 3,1, Apartado de Correos 98, C. P. 41410, Carmona, SEVILLE (Spain).

It is registered in the Mercantile Register of Seville in Volume 6179, Sheet 10, Page SE – 109.147, 1st Inscription. Its Tax Identification Number is B-90.256/017.

BRANDT’s privacy and data protection policy aims to maintain your trust by explaining the manner in which we collect, process, use and maintain the security of the personal data of Users.

The Privacy Policy contained herein is applicable to all personal data processed by the controller, regardless of whether they were obtained through the website or through any other means provided by the data subject.

As the company responsible for the website, in accordance with the provisions of Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce (LSSICE), BRANDT informs you that it has implemented the necessary security measures, both of a technical and organizational nature, to ensure and protect the confidentiality, integrity and availability of the data entered.

2. What personal data do we collect and process?

Most of the personal data obtained by BRANDT have been provided by the User (“Data Subject”) for specific purposes, such as when you subscribe to our company newsletter or when you request information through the “Contact” section of the website. Notwithstanding the foregoing, this data may be used for other purposes if we have the legal basis to do so. Likewise, we may obtain data about you from other companies and/or collaborators when you participate in events sponsored by BRANDT. In any case, you should be aware that your personal data will be collected, processed and used in accordance with the applicable data protection regulations.

The categories of personal data you provide to us directly or indirectly are as follows:

– Identification information. This refers to any information that identifies you as a natural person: name, surname, date of birth, education, position and company where you work, nicknames, aliases and avatars used on social media, identity and gender.

– Contact Information: This refers to any information that BRANDT may use to contact you: name, surname, telephone number, postal and/or email address, billing information, digital identity on social media, digital identity on videoconferencing programs, billing information where applicable and any communication channel that you may use to communicate with BRANDT.

This category also includes information related to communications maintained with BRANDT employees in any manner or medium and through any platform, including voice and/or video messages obtained through calls and/or videoconferences.

– Location Information: Given that our company is dedicated to crops and agriculture, in order to offer you products of interest to you, it is vitally important for us to know where you use and/or intend to use our products. We may collect information about the location of your different crops and/or your different residences when you choose to share it with us through the information submitted using the website https://brandteurope.com/, through the location information you share with us by social media, through the information you provide to us at the various trade shows at which BRANDT is present, through the information you provide to us when you register for an online event developed by BRANDT and/or its collaborators and/or at the various events it sponsors, or through any other means by which you may share your location with us.

– Information obtained from social media interaction: We may collect any information relevant to our business on the various social media channels on which we operate when you publicly or privately share information about yourself and/or your activity using these platforms. Likewise, we may obtain information about you when we develop advertising and marketing campaigns using these networks. The information we may collect will be that contained in your public profile or that resulting from your interactions with us in private, such as “likes”, “nicknames” or “hashtags”, and comments or messages, name, surname, date of birth, email address, education, centres at which you have studied, place of residence and position and place of employment.

– Photo and video information: This includes any photographs, voice and/or video files that we have obtained in which you can be identified. It includes recordings performed by BRANDT and/or its collaborators at technical seminars, meetings, trade fairs, congresses and other events that it organizes and/or in which it participates as a sponsor. It also includes any photographs and/or videos that you have sent and/or shared with us through social media.

– Information about your opinion of our products: This refers to any interaction with BRANDT and/or its collaborators in which you express your opinion and/or experience in relation to the use of products manufactured or marketed by BRANDT, either in person, or through our website or social media.

3. How we obtain your personal data. Purpose of the processing. Legal basis

The data may be obtained through any of the following channels, and it may be processed for the purpose listed in each of the categories:

a) Web contact form: This refers to the data we obtain when you fill in the required fields in the contact section of the website. The purpose of the processing is to respond to queries and/or questions posed by the User to BRANDT, according to the consent provided to us in accordance with Article 6(1)(a) of GDPR.

Before sending us your inquiry, you have the possibility to check a box to subscribe to the BRANDT newsletter, in which case you give us your consent to receive information about the company’s activities. You can find more details about this processing in the newsletter section.

As a result of your request, we will process some of the categories of data specified above, in particular, that related to “Contact Information”.

– Recipients:

In order to process the data obtained in the contact section, your data will not be transmitted to any third party, with the exception of the company that provides web hosting and email services to BRANDT. In any case, this company will be limited to receiving the information sent to us on its servers and its storage, all in accordance with a provision of services contract in application of the provisions of Article 28 of GDPR.

– Data retention period:

BRANDT will retain the information provided by the User until you request its deletion. The same period will apply to the data if you have given us your consent to use it for advertising purposes by subscribing to the newsletter.

b) Website registration form. This refers to the data that must be provided for your registration on the BRANDT website. The purpose is to provide the User with full access to the functions offered by the website. As a registered User on the website, BRANDT will use your personal data to send you personalized messages by email, including the newsletter. The legal basis for the processing is the execution of a contract after registering on our website and the company’s legitimate interest in keeping you informed about our products and services, all in application of articles 6(1)(b) and 6(1)(f) of GDPR.

As a result of your request, we will process some of the categories of data specified above, in particular, those related to “Contact Information” and “Identification Information”.

– Recipients:

In order to process the data obtained when registering on the website, your data will not be transmitted to any third party, with the exception of the company that provides web hosting and email services to BRANDT. In any case, this company will be limited to receiving the information sent to us on its servers and its storage, all in accordance with a provision of services contract in application of the provisions of Article 28 of GDPR.

For electronic subscription, we will use a double acceptance procedure to ensure that no error has occurred when entering the email address or that no third party has entered your email address without your consent. Your application to this service will only be registered when you click on the confirmation email.

– Data retention period:

BRANDT will retain the information provided by the User until you request its deletion.

c) Subscription to the newsletter through the website or by filling in physical forms. This refers to the data obtained when you subscribe to the newsletter through the website or when you provide us with your personal data by filling in the forms made available to Users at events in which the company participates. The purpose is to send commercial information, personalized where applicable, and participation in satisfaction surveys, prize draws, contests, promotions and offers, among others, through electronic and/or physical means. The legal basis for the processing is the consent provided to us when subscribing to the newsletter and the company’s legitimate interest in keeping you informed about our products and services as well as finding out your opinion on the issues raised in the surveys, all in application of articles 6(1)(a) and 6(1)(f) of GDPR.

Using your consent, we will create user profiles with the information obtained in order to send you personalized information. Although not personal data, user profiles may include:

– Information on crops: This refers to any information about the types of crops you produce.

– Information on phytosanitary products: This refers to the products you use on your crops related to nutrients and plant health in tree crops, industrial crops, horticultural crops, turf, ornamental plants and any other crop to which BRANDT may extend its line of business in the future.

As a result of your request, we will process some of the categories of data specified above, in particular, those related to “Contact Information”, “Identification Information”, “Location Information”, “Photo and Video Information” and “Information about your Opinion of our Products”.

– Recipients:

In order to process the data obtained from the subscription to the newsletter, your data will be transmitted to the company that provides web hosting and email services to BRANDT. Likewise, your data may be transmitted to the information service providers that help us carry out promotional campaigns such as MailChimp or GroupMail. In any case, the data of this supplier will appear in the promotional email that we send you, allowing you to consult their privacy policy. Electronic or physical mailings are carried out under a provision of services contract in accordance with the provisions of Article 28 of GDPR.

Your application to this service will only be registered when you click on the confirmation email.

– Data retention period:

BRANDT will retain the information provided by the User until you request its deletion.

d) Social media interaction. This refers to the data obtained through the User’s interaction with the company’s social media accounts. Likewise, the company may share the information collected with third party advertising platforms, such as Facebook, for advertising on those platforms, without allowing the platforms to use the information for activities outside of BRANDT’s mandate under any circumstances. When advertising on platforms, we may also obtain personal data indirectly from social media companies when we advertise on such platforms (Facebook and its companies, Google and its companies and other social media), which may include your participation and subscription in specific topics or groups, your profile settings and preferences and your behavior on the different platforms.

In the delivery of advertising, we may use third party platforms such as Google Analytics and Facebook Business Manager in order to properly target campaigns and thus determine the optimal time and place to show you such advertising.

If you want more information about the use of the data we share with social media companies, you can read their privacy policy. In any case, we stress that if your data is shared, it is for the execution of the advertising campaign. Therefore, under no circumstances will the platforms become Data Controllers or Co-Controllers, nor will they be able to use your data according to their purposes.

The purpose is, on one hand, to respond to the queries sent to us through these means where applicable and, on the other, to satisfy our legitimate interest in keeping you involved in your preference for the products and services that BRANDT may offer, all in accordance with Article 6(1)(a) and 6(1)(f) of GDPR.

As a result of your request, we will process some of the categories of data specified above, in particular, those related to “Location Information”, “Photo and Video Information”, “Information Obtained from Social Media Interaction” and “Information about your Opinion of our Products”.

– Recipients:

In order to process the data obtained, your data will be transmitted to the company that provides web hosting and email services to BRANDT. Likewise, for the implementation of advertising campaigns, your data may be transmitted to social media companies, under a service provision contract in accordance with the provisions of Article 28 of GDPR.

– Data retention period:

BRANDT will retain the information provided by the User until you request its deletion.

e) Information obtained at technical seminars, meetings, trade fairs, congresses and other events organized by BRANDT or in which it participates as a collaborator/sponsor. This refers to the personal data you provide directly or indirectly at these events. The purpose is, on one hand, to respond to the queries sent to us through these means where applicable and, on the other, to satisfy our legitimate interest in keeping you involved in your preference for the products and services that BRANDT may offer, all in accordance with Article 6(1)(a) and 6(1)(f) of GDPR.

As a result of your request, we will process some of the categories of data specified above, in particular, those related to “Identification Information”, “Contact Information” and “Information about your Opinion of our Products”.

– Recipients:

In order to process the data obtained, your information will be transmitted to the company that provides web hosting and email services to BRANDT, under a processing contract that is in line with the provisions of Article 28 of GDPR.

– Data retention period:

BRANDT will retain the information provided by the User until you request its deletion.

4. Recipients outside the EU

Some of the companies listed above with which we share your information for the specified purposes are based outside the European Union or the European Economic Area. Where this is the case, you should be aware that the transmission is carried out after having implemented the necessary measures, such as signing the Standard EU Contractual Clauses approved by the European Commission and appropriate security safeguards.

5. What are your rights as the data subject?

In application of the GDPR, the data subject has the following rights:

  • The right to request access to personal data relating to the data subject;
  • The right to request their rectification;
  • The right to request their deletion;
  • The right to request the limitation of the processing;
  • The right to object to the processing;
  • The right to data portability;
  • The right to file a complaint with the Spanish Data Protection Agency.

For cases in which the processing is based on consent under Article 6(1)(a) of GDPR, the data subject may withdraw this consent at any time they deem appropriate. This withdrawal will not affect any actions carried out previously on the basis of such consent.

The data subject may exercise these rights by sending a request accompanied by a copy of their ID card, specifying which of these rights they wish to exercise. The interested User will not incur any charges for exercising these rights.

In addition to the above, for cases in which the data subject wishes to stop receiving our newsletter and marketing communications, they can unsubscribe directly through the option contained in such mailings.

6. How do we protect your data?

BRANDT’s technical and organizational security measures are in line with the information it collects and processes. To protect your data we have security measures such as access controls, firewalls and encrypted navigation through an SSL certificate. Thus, all data transmitted by the User are encrypted, although we cannot guarantee that unauthorized third parties (government agencies and hackers usually at their service) can access them while the data are in transit over the Internet.

Through contractual agreements, we require the companies with which we share your data to apply at least similar measures to ours.

Keep in mind that security is not absolute. Therefore, you should take precautions when browsing the Internet in order to prevent malicious third parties from taking control of your device and gaining access to your private information.
